Guarantee scheme
The Banking System Deposit Guarantee Fund (BSDF) contributes to the stability of the financial system and strengthens depositors' confidence by providing compensation for deposits that have become unaffordable. Deposits in national and foreign currency of individuals and legal entities, both residents and non-residents, are guaranteed up to the coverage level.
The following deposits are excluded deposits and are not guaranteed by the Bank Deposit Guarantee Fund:
a) the own funds of the member institution, owned by it, or the deposits of a legal entity controlled by the respective member institution;
b) deposits placed by other banks or other organizations licensed or authorized by the National Bank, the National Financial Market Commission or, in the case of foreign banks, by a foreign supervisory authority;
c) warehouses of central or local public authorities;
d) deposits declared illegal by court decision. The Fund suspends the payment of deposits to persons against whom an action has been filed in court regarding the legality of the respective deposits until the court decision becomes final and irrevocable;
e) deposits originating from activities related to money laundering and terrorist financing, a fact confirmed by a final and irrevocable court decision;
f) deposits whose holders were not or cannot be identified at the time of the unavailability of the respective deposits;
g) debt securities, issued by the member institution, and debts arising from own acceptances and promissory notes;
h) deposits or other instruments that count for the regulated capital of the member institution, according to the applicable legislation.
The following deposits benefit from a level of coverage equal to 200% of the level of coverage, for a period of up to 3 months after the amount has been credited or from the date on which the respective deposits can be legally transferred:
a) deposits of natural persons resulting from real estate transactions regarding residential real estate;
b) amounts deposited as settlements or compensation resulting from divorce, retirement, dismissal, disability, death; and
c) deposits of natural persons resulting from the payment of insurance indemnities or the reparation of damage caused by a crime or illegal conviction.
In the case of joint accounts, when calculating the amount of the guaranteed deposit for each depositor, the part of the balance allocated to each depositor is taken into account. Except as otherwise provided in the deposit agreement, each full holder of the joint account is presumed to own an equal share of the balance of this account.
In the case of deposits placed for the benefit of a third party, compensation rights are assigned to the third party, provided that person has been identified or can be identified by the date of unavailability of the deposit.
In case of merger of member institutions, the deposits of the depositor who held deposits in both member institutions are separately guaranteed (double coverage), for 3 months after the completion of the merger process. The merger process is considered completed on the date of registration of the merger with the authority that performed the state registration of the absorbing legal entity or that is to register the new legal entity.
Coverage level
is of 200 000 lei and represents the maximum amount guaranteed by the Bank Deposit Cover Fund per depositor and per member institution, irrespective of the number of deposits held by the depositor, the size and currency of these deposits.
Deposits in foreign currency shall be guaranteed by offsetting their equivalent in MDL at the official exchange rate set by the National Bank on the date of unavailability of the respective deposits.
Compensation of deposits
FGDSB continues to ensure the payment of compensations for deposits that have become unavailable as a result of the withdrawal of the license to carry out the financial activities of BC "Universalbank" SA (liquidated), as well as of the banks in the process of liquidation: Banca de Economii SA, BC "Banca Socială" SA, BC "UNIBANK" SA within the limit of the coverage level established on the date of unavailability of these deposits - 6,000 (six thousand) lei.
In accordance with the legislation of the Republic of Moldova, guaranteed deposits are returned to depositors or other authorized persons (by power of attorney, heir certificate, etc.), provided that an identity document containing the IDNP is presented. The refund can be made either in cash at the FGDSB headquarters, or by transfer to the beneficiaries' accounts.
To withdraw the amount of the guaranteed deposit, the depositors of the banks mentioned above are asked to contact the FGDSB office.
If a bank's deposits become unavailable, FGDSB compensates these deposits to individuals and legal entities, both resident and non-resident, within the coverage level.
FGDSB starts clearing deposits no later than 7 working days from the date of unavailability of deposits.
At the same time, FGDSB publishes a notice informing depositors about the compensation of guaranteed deposits, the period in which it will take place, the method of payment, the place and name of the paying agent, if applicable, as well as all the requirements and formalities necessary to obtain access to compensation. The said notice is published on the official website of the FGDSB and distributed by any means that the FGDSB deems necessary to reach as many depositors as possible, including through social communication platforms, television stations, radio and newspapers.
Payment of guaranteed deposits is made in Moldovan lei. Deposits in foreign currency are compensated by paying their equivalent in Moldovan lei at the official rate of the National Bank of Moldova of the Moldovan leu to the respective foreign currency, from the date of ascertaining the unavailability of the deposits.
Payments are made in full within the coverage level, in cash, by transfer or by other forms of payment, directly by the FGDSB or through a paying agent. Paying agent is an entity designated by the FGDSB to compensate a bank's depositors in cases where their deposits become unavailable. FGDSB may select one or more banks to act as paying agent in the clearing process.
Payment of guaranteed deposits can also be made to other persons in accordance with the legislation of the Republic of Moldova (on the basis of power of attorney, certificate of heir, etc.). Payment of guaranteed deposits opened in favor of a minor child is made to his parents or guardians/curators.
FGDSB is not obliged to compensate a depositor if, for 24 months until the date of unavailability of the deposit, there has been no transaction related to this deposit (inactive account) and the amount of the deposit is less than the administrative costs that FGDSB would bear in connection with compensation.
Any unclaimed guaranteed deposits remain with the respective depositors and can be claimed at any time with FGDSB.
From the beginning of its activity until now, FGDSB has compensated guaranteed deposits in the total amount of 50,248.5 thousand lei, of which:
1. The guaranteed deposits of BC "Investprivatbank" SA in the process of liquidation in the total amount of 48,091.7 thousand lei, transferred in favor of "Banca de Economii" SA based on art. 2 of Law no. 190 of 30.09.2011 regarding some additional measures to ensure financial stability (24.10.2011);
2. Guaranteed deposits of BC "Universalbank" SA (liquidated) in the total amount of 2,026.5 thousand lei (from 2012 to the present);
3. The guaranteed deposits of SA "Banca de Economii" in the process of liquidation in the total amount of 36.5 thousand lei (from 2015 to the present);
4. The guaranteed deposits of BC "Banca Socială" SA in the process of liquidation in the total amount of 93.8 thousand lei (from 2015 to the present).
